Terms of Service

These Terms of Service ("Terms") govern your use of pnm.now (the "Site") and any related newsletter, membership, or subscription services (collectively, the "Service") operated by Sauces 201 LLC, a New York limited liability company ("we," "us," or "our").

By accessing the Site or subscribing to the Service, you agree to these Terms. If you do not agree, do not use the Service. If you use the Service as a consumer, these Terms do not affect any mandatory legal rights you have that cannot be waived by agreement (see Section 12).

1. The Service

PNM Now is an independent travel loyalty news publication. We publish a daily newsletter covering program changes, devaluations, transfer bonuses, and related developments in the travel rewards space. The Service includes:

We may modify, suspend, or discontinue parts of the Service. Where this materially affects a paid subscription you've already purchased, we will give you reasonable notice and, where required by law, a proportionate refund.

2. Eligibility

You must be at least 16 years old to use the Service. By using the Service, you represent that you meet this requirement. Some countries set a lower minimum age for consent to data processing; where that applies, the local minimum governs. If you are under 18, you represent that you have your parent or guardian's permission.

3. Accounts and Subscriptions

Free subscriptions

You may subscribe to the free newsletter by providing your email address. You are responsible for maintaining the confidentiality of your account and for activity that occurs under it.

Paid subscriptions

Paid membership tiers are billed on a recurring basis (monthly or annual) via Stripe. By subscribing to a paid tier, you authorize us to charge your payment method on a recurring basis until you cancel.

Founding member pricing

Founding member rates, if offered, are locked for the duration of your continuous subscription. If you cancel and re-subscribe, the founding rate no longer applies.

4. Right of Withdrawal (EU, EEA, and UK consumers)

If you are a consumer resident in the EU, EEA, or UK, you have the right to withdraw from a paid subscription within 14 days of purchase, without giving any reason. To exercise it, tell us clearly before the period ends — for example, by emailing hello@pnm.now. We will refund the payment we received from you without undue delay.

Because the paid subscription provides immediate digital access, by starting your subscription you expressly request that we begin providing the Service during the 14-day period and acknowledge that you lose the right of withdrawal once the Service has been fully performed. If you withdraw while the Service has only been partially performed, you may owe a proportionate amount for the access already provided. This does not affect any stronger refund rights granted by your local law.

We may suspend or terminate your account if you materially or repeatedly breach these Terms. Where you are a consumer and it is reasonable to do so, we will give you notice and a chance to put things right first.

6. Intellectual Property

All content published on the Site and in the newsletter — including articles, headlines, analysis, and editorial copy — is owned by Sauces 201 LLC or its contributors and is protected by copyright law.

You may share individual articles or excerpts for personal, non-commercial use, provided you clearly attribute PNM Now and link to the original. You may not reproduce substantial portions of our content without written permission.

The PNM Now name and logo are trademarks of Sauces 201 LLC. You may not use them without our written consent.

7. Editorial Independence

PNM Now does not accept credit card affiliate links, referral commissions from card issuers, or advertising from financial products we cover editorially. Our editorial decisions are made independently of our commercial relationships.

8. Data Protection and Privacy

We process personal data in accordance with our Privacy Policy, which forms part of these Terms. Sauces 201 LLC is the data controller for personal data collected through the Service.

If you are in the EU, EEA, UK, or Switzerland, we process your data under the General Data Protection Regulation (GDPR) on the legal bases described in our Privacy Policy. You have the rights to access, rectify, erase, restrict, port, and object to the processing of your personal data, to withdraw consent where processing is based on it, and to lodge a complaint with your local supervisory authority. Our Privacy Policy explains how to exercise these rights.

9. Disclaimers

Except where applicable law provides otherwise, the Service is provided on an "as is" and "as available" basis. To the extent permitted by law, we make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

The content published by PNM Now is for informational purposes only and does not constitute financial, investment, or legal advice. Travel loyalty programs change frequently. We make reasonable efforts to ensure accuracy but cannot guarantee that all information is current or complete. You should independently verify material information before making financial or travel decisions.

We are not responsible for the content, policies, or practices of any third-party websites linked from the Site.

Nothing in this Section excludes or limits any warranty, guarantee, or legal right that cannot be excluded or limited under the law that applies to you — including the mandatory consumer-protection rights of consumers in the EU, EEA, and UK.

10. Limitation of Liability

Nothing in these Terms excludes or limits our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence; for fraud or fraudulent misrepresentation; for gross negligence or willful misconduct; under Article 82 GDPR for damage caused by unlawful processing of personal data; and any other liability that cannot be excluded under applicable law.

Subject to the paragraph above, and to the maximum extent permitted by law, Sauces 201 LLC and its members, officers, and contributors will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total liability for any claim arising out of or related to these Terms or the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or US$100.

If you are a consumer, the limitations above apply only to the extent permitted by the mandatory law of your country of residence. In particular, we remain responsible for loss or damage that is a foreseeable result of our breaking these Terms or failing to use reasonable care and skill, and the cap above does not limit any liability your local law does not allow us to limit.

11. Indemnification

To the maximum extent permitted by applicable law, you agree to indemnify and hold harmless Sauces 201 LLC and its members, officers, and contributors from claims, liabilities, damages, losses, and reasonable expenses arising out of your unlawful use of the Service or your breach of these Terms. This Section does not apply to the extent a loss results from our own conduct, and — if you are a consumer — applies only to the extent permitted by the mandatory law of your country of residence.

12. Your Rights as a Consumer

If you use the Service as a consumer, you benefit from the mandatory provisions of the law of your country of residence. Nothing in these Terms affects your right to rely on those mandatory provisions, and nothing in these Terms limits any statutory right that cannot be waived by agreement.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law provisions, and any dispute will be resolved in the state or federal courts located in New York County, New York. For disputes under US$10,000, either party may elect binding arbitration under the American Arbitration Association's Consumer Arbitration Rules, seated in New York County.

If you are a consumer resident in the EU, EEA, or UK, the paragraph above does not deprive you of the protection of the mandatory laws of your country of residence. You may bring proceedings in the courts where you live, and those mandatory laws apply to the extent they give you greater protection. The arbitration provision does not apply to you where it conflicts with your local mandatory rights. You may also be entitled to use an Alternative Dispute Resolution (ADR) body in your country; contact us and we will tell you whether an applicable scheme is available.

14. Changes to These Terms

We may update these Terms. Material changes will be communicated to subscribers by email at least 14 days before they take effect, and the "Last updated" date above will change. Your continued use of the Service after changes take effect constitutes acceptance, except that changes will not apply retroactively to a dispute that has already arisen. If you are a consumer and do not accept a material change, you may cancel before it takes effect.
